Bookings and payment
2. When you make a Booking more than 7 days before your Arrival Date, you will be required to pay a deposit equal to at least the first night’s Rate of the Booking (Deposit). You will then be required to pay the balance of your Booking at least 3 days prior to your Arrival Date.
3. When you make a Booking where the Arrival Date falls within the next 7 days, you will be required to pay the total cost of your Booking.
4. Once you pay for your Booking (either in whole or in part), you will be deemed to have accepted these Terms.
5. Once we have processed the payment for your Booking, we will confirm the details of your Booking with you in writing. This confirmation creates an agreement between You and Us (Agreement).
6. If you pay by Amex, MasterCard or Visa credit or debit card we will charge a card surcharge equivalent to the surcharge applied by the card provider. The surcharge amount will be displayed at the point of booking before you proceed to payment.
7. Some of our Rates include meals, if you make a Booking on a Rate with meals included, or purchase mealsseparately, our Meals Terms and Conditions apply.
8. There may be instances where you try to make a Booking but we are unable to accommodate you. We try to avoid this as much as possible, but if this happens, we will notify you that your Booking has been unsuccessful.
Changing your booking
9. If you would like to change your Booking for any reason, you must obtain Leonora Village’s prior consent to do so.
10. While we will try our best, Leonora Village may not be able accommodate your request to change your Booking for any reason whatsoever.
11. If we agree to change your Booking, we may adjust the Rate that applies to your Booking to reflect the applicable Rate on the changed Booking dates. In legal terms, this varies the Agreement between you and us. In practical terms, this means that the total cost of your Booking may change.
Cancelling your booking – 5 people or less
12. We understand that from time to time, you may need to cancel your Booking.
13. The following cancellation policy applies to Bookings of five (5) people or less.
14. If you cancel your Booking, then the following cancellation policy applies:
- If you cancel your Booking more than 72 hours before the Standard Time on your Arrival Date, you will receive a full refund.
- If you cancel your Booking less than 72 hours before the Standard Arrival Time on your Arrival Date, you forfeit your Deposit, which is equal to the cost of the first night of your Booking detailed in clause2 of these Terms.
- The forfeited Deposit cannot be transferred to another date, or placed in credit for future use without written consent from Leonora Village.
- Once you have checked in, if you make changes to your Booking, such as leave early, you will forfeit the full amount set out in your Booking. This is, you will not receive a refund for nights unused.
15. If you are a No Show your Booking will be cancelled and you will not be entitled to a refund. That is, you will still be required to pay the full amount set out in your Booking.
Cancelling your booking – 6 people or more
17. If you cancel your Booking of six (6) people or more, then the following cancellation policy applies:
- If you cancel your Booking more than 7 days before the Standard Time on your Arrival Date, you will receive a full refund.
- If you cancel your Booking less than 7 days before the Standard Arrival Time on your Arrival Date, you forfeit your Deposit, which is equal to the cost of the first night of your Booking detailed in clause2 of these Terms.
- The forfeited Deposit cannot be transferred to another date, or placed in credit for future use without written consent from Leonora Village.
- Once you have checked in, if you make changes to your Booking, such as leave early, you will forfeit the full amount set out in your Booking. This is, you will not receive a refund for nights unused.
18. If you are a No Show your Booking will be cancelled and you will not be entitled to a refund. That is, you will still be required to pay the full amount set out in your Booking.
Liability
19. You are solely responsible for your property at all times at Leonora Village.
20. If your property is lost, stolen, or damaged at Leonora Village, we are under no obligation to:
- replace the property;
- compensate you for; or
- be liable for any loss or damage suffered as a result.
21. To the maximum extent permitted by law, we are not responsible or liable for any accident or, direct or indirect loss including but not limited to loss suffered to property or person, damage, fatality, injury, psychological injury, inconvenience, loss of enjoyment, disappointment or health related issue whatsoever during your stay at Leonora Village.
22. You agree to fully and finally release and discharge us from any liability, claim, action, right or entitlement whatsoever you have against us whether known or unknown, whether accrued, contingent or inchoate arising out of, concerning or relating to your stay.
23. If you wish to claim any refund you must contact Leonora Village directly by phone.
24. If a condition or warranty cannot be excluded at law then you agree to the fullest extent permitted by law that our liability for a breach of the condition or warranty shall be, at our sole election, the re-supply or payment of the cost of re-supply of the relevant goods or services. All other conditions and/or warranties are expressly excluded to the fullest extent permitted by law.
25. You fully indemnify us against any loss, liability, damage, action, demand, expense, claim, fine, charge or obligation which we have or may suffer or incur by reason of or in any way consequent upon, arising out of or incidental to the non-performance or non-observance of the obligations and liabilities imposed on you under this Agreement or by reason of or concerning or arising out of your conduct, act or omission on or related to the Booking or your stay at Leonora Village.
Miscellaneous
26. We take your privacy seriously and treat your personal information strictly in accordance with our obligations under the Privacy Act 1988 (Cth).
27. These Terms and the Agreement are governed by the laws of Western Australia and you agree to submit to the exclusive jurisdiction of the courts of Western Australia.
28. If any clause in this Agreement becomes invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining clauses of this Agreement shall not in any way be affected or impaired.
29. This Agreement may only be varied by a document in writing executed by all parties’ authorised representatives.
30. You acknowledge and accept the above Terms applying with respect to the Booking and acknowledge having read and understood them. You understand that no other agreement or disclaimer, verbal or otherwise, applies as this Agreement together with the itinerary contains the entire agreement between you and us.
31. You confirm you are over 18 years of age and free to enter into these Terms and the Agreement.
32. We may cancel this Agreement at any time if we believe your Booking may cause disruption to the operation of Leonora Village or guests.
Your rights – Australian Consumer Law
Contact details and notices
Any notice required to be given by a party under the Agreement must be given in accordance with the particulars set out in the Purchase Pages or these Terms.
It is your responsibility to keep your contact details, including your email address and postal address up to date and notify Leonora Village of any changes to those details as soon as possible.
Termination and variation
The Agreement may be terminated by Leonora Village at any time by notice in writing to you if you breach these Terms.
You are bound by the latest version of these Terms. Leonora Village will use reasonable endeavours to notify you of any changes to the Terms and Conditions by placing a notice on the Website. Where there are material changes to these Terms that could adversely affect or limit your rights under the Agreement, Leonora Village will provide additional notice to you by way of the address or email address you have provided to Leonora Village and you thereafter have the right to cancel your Booking in accordance with clause14 or17. Where possible, we will endeavour to give at least 1 months’ notice of such changes.

Definitions
In these terms a reference to:
“Arrival Date” means the date you’re set to arrive as set out in your Booking.
“Agreement” has the meaning given to it in clause 5 of these Terms.
“Booking” means your reservation for accommodation at RAC Parks and Resorts.
“Deposit” has the meaning given to it in clause 2 of these terms.
“Group Booking(s)” has the meaning given to it in clause X of these terms.
“GST” means goods and services tax imposed or to be imposed under the A New Tax System (Goods and Services Tax) Act 1999 (as amended) (Cth) and any related imposition Acts of the Commonwealth, or any Act in substitute for them.
“Kitchen” means the location in which meals may be served.
“No Show” means the event where You do not present at Leonora Village on your Arrival Date.
“Occupant” means a person staying in the accommodation or on the site that the booking has been made for.
“Personal Information” has the meaning given to it in the Privacy Act 1988 (Cth).
“Leonora Village” means Leonora Village Pty Ltd (ABN 33678011688) of 172 Fullarton Rd, Dulwich, SA 5065.
“Rate(s)” means the price per night outlined in your Booking and is based on 2 people unless expressly provided otherwise.
“Standard Arrival Time” means 2pm on your Arrival Date.
“Terms” means these terms and conditions that you are currently reading.
“us, our, we” means Leonora Village Pty Ltd (ABN 33678011688) of 172 Fullarton Rd, Dulwich, SA 5065.
“you or your” means you, our valued customer, as set out in the Booking (and includes any other person who participates in, is present at or attends the Booking as a participant).
